Processing of personal data and information for the data subject



Privacy Policy

I. Basic provisions

According to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as "GDPR"), Paybill is the data controller. s.r.o. (further referred to as: "administrator").

Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is a person who can be directly or indirectly identified, in particular by reference to a specific identifier such as a name, identification number, location data, network identifier, or one or more specific elements of the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
The manager did not appoint a data protection officer.


II. Sources and categories of processed personal data

The administrator processes personal data that you have provided to him or personal data that the administrator has obtained based on fulfilling your order.
The administrator processes your identification and contact details, as well as data necessary for fulfilling the contract.


III. Legal basis and purpose of processing personal data

The legal basis for processing personal data is:
- fulfillment of the contract between you and the administrator according to Article 6 (1) (b) of the GDPR,
- legitimate interest of the data controller in providing direct marketing (especially for sending commercial communications and newsletters) according to Art. 6 (1) (f) GDPR,
- Your consent to the processing for the purpose of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) of the GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, in case no goods or services have been ordered.
The purpose of processing personal data is
- processing your order and performing the rights and obligations arising from the contractual relationship between you and the administrator; personal data is required when placing an order, which is necessary for successful order processing (name and address, contact information), providing personal data is a necessary requirement for entering into and fulfilling the contract, without providing personal data it is not possible to conclude the contract or have it fulfilled by the administrator.
- sending commercial messages and conducting other marketing activities.
The administrator engages in automatic individual decision-making in accordance with Article 22 of the GDPR. You have provided your explicit consent to such processing.


IV. Data retention period

The administrator stores personal data.
For the period necessary to perform the rights and obligations arising from the contractual relationship between you and the administrator and to assert claims from these contractual relationships (for a period of 10 years after the termination of the contractual relationship).
For the duration until the consent for the processing of personal data for marketing purposes is revoked, up to a maximum of 3 years, if personal data is processed based on consent.
After the expiration of the retention period, the data controller will delete the personal data.


V. Recipients of personal data (subcontractors of the data controller)

The recipients of personal data are individuals.
involved in the delivery of goods/services/payment execution based on a contract.
providing services for operating an e-shop and other services related to e-shop operation.
providing marketing services.
for the purpose of accounting for tax documents in accordance with the contract and with generally binding legal regulations to the extent:
- first name and last name, title
- mailing address,
- billing address
- email address.
- phone contact,
- bank account information,
- information about the subject of performance Administrator.
The administrator does not intend to transfer personal data to a third country (outside the EU) or an international organization.


VI. Your rights

For the conditions set by GDPR, you have:
- the right to access one's personal data according to Article 15 of the GDPR,
- the right to rectify personal data according to Article 16 of the GDPR, or to restrict processing according to Article 18 of the GDPR.
- the right to erasure of personal data according to Article 17 of the GDPR.
- the right to object to processing under Article 21 of the GDPR
- the right to data portability according to Article 20 of the GDPR.
- The right to withdraw consent to the processing can be exercised in writing or electronically to the address or email of the administrator stated in Article III of these terms.
You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.


VII. Conditions for securing personal data

The administrator declares that they have taken all appropriate technical and organizational measures to secure personal data.
The administrator has implemented technical measures to secure the data storage (login name, password, antivirus program, and firewall) and the storage of personal data in physical form (locked room).
The administrator states that only persons authorized by him have access to personal data.


VIII. Final provisions

By submitting an order through the online order form, you confirm that you have read and accept the terms of personal data protection in their entirety.

The administrator is entitled to change these conditions. The new version of the privacy policy will be published on their website and at the same time they will send you the new version of these conditions to your email address that you provided to the administrator.


These terms and conditions shall become effective on May 25, 2018.
